By accessing or using this Site in any way—including browsing, submitting inquiries, placing orders, or viewing content—you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. Use of the Website
You may use this Site for lawful purposes only.
You must be at least 18 years old or have the consent of a parent or legal guardian.
We reserve the right to restrict or terminate access for any reason without notice.

2. Orders, Quotes & Payments
Custom Orders & Inquiries:
All custom cake orders require a formal quote and may require a deposit to confirm.
Submitting an inquiry form does not guarantee availability or pricing.
Pricing is based on size, design complexity, materials, and delivery location.
Quotes are valid for a limited time and subject to change.

Payment & Cancellation:
Deposits are non-refundable unless otherwise stated in writing.
Full payment is due prior to pickup or delivery, unless other terms are arranged.
Order cancellations must be made at least [X days] in advance to be eligible for any refund, subject to management discretion.

3. Shipping & Delivery
Crave’n Cups and other eligible products are shipped via third-party carriers.
Shipping times are estimates and not guaranteed.

We are not responsible for delays or damage once an order has been handed off to the carrier.
Shipping is currently only available within the U.S. and select territories.

4. Allergies & Food Safety
We take food safety seriously. However, our kitchen handles allergens including but not limited to: milk, eggs, tree nuts, peanuts, wheat, soy, and gluten.
While we offer vegan and gluten-free options, our products are not certified allergen-free and may contain trace cross-contact.
Customers are responsible for disclosing allergies and dietary needs at the time of inquiry.
We employ Certified Food Safety Managers and train all team members on food handling protocols in accordance with Florida regulations.

5. Intellectual Property
All content on this Site—including images, logos, designs, text, and videos—is the property of The Cake Girl, LLC or its licensors.
You may not copy, reproduce, distribute, or use any content without prior written permission.

6. User Content & Submissions
Any testimonials, photos, or reviews submitted to us may be used in our marketing unless otherwise requested in writing.
By submitting content, you grant us a royalty-free, worldwide license to use, publish, and share it.

7. Franchise Content & Inquiries
Information on our Franchise page is for exploratory purposes only.
Submitting a franchise interest form does not constitute an offer to sell or award a franchise.
Franchise sales are made only through our Franchise Disclosure Document (FDD), which will be provided upon mutual interest and qualification.

8. Disclaimer of Warranties
The Site and all content are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to:
• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy of information
We do not guarantee that the Site will be uninterrupted or error-free.

9. Limitation of Liability
To the fullest extent permitted by law, The Cake Girl, LLC and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site, products, or services.

Any disputes shall be resolved in the courts located in Hillsborough County, Florida.
